Terms of Service

These terms (the "Terms") govern your use of the VargPilot website (vargpilot.rapidfusion.net), the VargPilot Android application, and any related services we offer (collectively, the "Service"). The Service is operated by RapidFusion / Ben Selinger ("we", "us"). By creating an account or otherwise using the Service, you agree to these Terms.

Plain-English summary: VargPilot is a third-party app for the Stark Varg motorcycle. It is not made by Stark Future. It's offered as-is, mostly for free during beta. Use it at your own risk. Don't ride distracted. Don't use it to modify your bike beyond what's safe. Don't break the law with it. We can disable accounts that abuse the service or harm other users.

1. Eligibility + accounts

  • You must be 16 or older to use the Service.
  • You're responsible for keeping your account credentials secret. Notify us promptly at ben.selinger@rapidfusion.net if you suspect unauthorized use.
  • You're responsible for all activity that happens under your account.

2. Subscriptions + plans

  • The Service is currently in beta. New accounts receive a free 30-day "Beta" plan that grants full feature access. We may extend, modify, or replace this plan during beta without notice.
  • We may introduce paid plans in the future. Pricing and terms for any paid plan will be presented to you before purchase, and continued use of the Service after a billing cycle constitutes acceptance of those terms.
  • Refunds, where applicable, will be governed by the specific terms of the paid plan.

3. Acceptable use

You agree NOT to:

  • Use the Service to violate any law or regulation.
  • Reverse-engineer, decompile, or attempt to derive the source of the Service except where allowed by mandatory applicable law.
  • Use the Service to harm, harass, or impersonate other users.
  • Bypass authentication, rate-limiting, or access-control mechanisms.
  • Resell or redistribute access to the Service without our written consent.
  • Use automated means (scrapers, bots) to access the Service beyond what's reasonable and customary.
  • Use the Service in any way that interferes with another user's safe operation of their motorcycle.

4. Riding safety + bike modification

VargPilot is a software tool for monitoring and configuring an electric motorcycle. It is not a substitute for attentive riding, proper protective gear, or professional mechanical service.

  • Don't operate the app while riding. Mount your phone and configure before you ride.
  • Power-curve and regenerative-braking maps configured through VargPilot can change your bike's behaviour significantly. Test changes in a safe, low-stakes environment before riding aggressively.
  • Lock / unlock features depend on Bluetooth-link reliability and a charged phone. Don't rely on the app as your only means of securing the bike.
  • You assume all risk associated with riding your motorcycle, including risk arising from configuration choices made via VargPilot.

5. Relationship to Stark Future

VargPilot is an independent third-party project. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Stark Future AB or any of its subsidiaries. "Stark" and "Stark Varg" are trademarks of Stark Future and used here only for descriptive interoperability. Use of VargPilot may violate the Stark stock-app's terms or your bike's warranty — check with Stark directly if that's a concern for you.

6. Intellectual property

  • The VargPilot software, website, design, and brand are our intellectual property.
  • You retain ownership of any content you input into the Service (account name, bike configurations, etc.).
  • You grant us a non-exclusive, worldwide, royalty-free license to store and process your data solely as necessary to operate the Service.

7. Termination

  • You can delete your account at any time by emailing ben.selinger@rapidfusion.net (in-product self-serve deletion is on the roadmap).
  • We can suspend or terminate accounts that violate these Terms, abuse the Service, or threaten its security or availability for other users. We'll notify you when reasonable.
  • Sections of these Terms that by their nature should survive termination (IP, disclaimers, limitations of liability, governing law) survive.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. While we take reasonable care, we cannot guarantee compatibility with all phones, all bike firmware versions, or any specific operational outcome.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD 50.

Some jurisdictions do not allow these limitations; in those places, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold us harmless from any claim, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will update the "Last updated" date at the top and we'll send existing accounts a one-time email. Continued use of the Service after changes take effect means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms must be brought in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of those courts. Nothing in this section waives any non-waivable consumer-protection rights you have in your home jurisdiction.
